4) CONTACTING US

4.1 Personal data is collected when contacting us (e.g. via contact form or e-mail). Which data is collected in case of using a contact form can be seen from the respective contact form. This data is stored and used exclusively for the purpose of responding to your request or for contacting you and the associated technical administration. The legal basis for the processing of this data is our legitimate interest in responding to your request in accordance with Art. 6 (1) lit. f DSGVO. If your contact aims at the conclusion of a contract, the additional legal basis for the processing is Art. 6 (1) lit. b DSGVO. Your data will be deleted after final processing of your request. This is the case if it can be inferred from the circumstances that the matter concerned has been conclusively clarified and provided that there are no statutory retention obligations to the contrary.

4.2 WhatsApp business

We offer visitors to our website the possibility to contact us via the messaging service WhatsApp of WhatsApp Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland. For this purpose, we use the so-called "business version" of WhatsApp.

If you contact us via WhatsApp on the occasion of a specific transaction (for example, an order placed), we store and use the mobile phone number you use on WhatsApp and - if provided - your first and last name pursuant to Art. 6 para. 1 lit. b. DSGVO to process and respond to your request. On the basis of the same legal basis, we may ask you to provide further data (order number, customer number, address or email address) via WhatsApp in order to be able to assign your request to a specific process.

If you use our WhatsApp contact for general inquiries (such as about the range of services, availability or our website), we store and use the mobile phone number you use on WhatsApp and - if provided - your first and last name in accordance with Art. 6 (1) lit. f DSGVO based on our legitimate interest in the efficient and timely provision of the requested information.

Your data will only ever be used to respond to your request via WhatsApp. It will not be passed on to third parties.

Please note that WhatsApp Business receives access to the address book of the mobile device we use for this purpose and automatically transfers phone numbers stored in the address book to a server of the parent company Facebook Inc. in the USA. For the operation of our WhatsApp Business account, we use a mobile device whose address book only stores the WhatsApp contact data of those users who have also contacted us via WhatsApp.

This ensures that each person whose WhatsApp contact data is stored in our address book has already consented to the transmission of his WhatsApp telephone number from the address books of his chat contacts in accordance with Art. 6 (1) lit. a DSGVO when using the app on his device for the first time by accepting the WhatsApp terms of use. A transmission of data of such users who do not use WhatsApp and/or have not contacted us via WhatsApp is excluded in this respect.

For the purpose and scope of the data collection and the further processing and use of the data by WhatsApp, as well as your rights in this regard and setting options for protecting your privacy, please refer to the privacy notices of WhatsApp: https://www.whatsapp.com/legal/?eea=1#privacy-policy

5) DATA PROCESSING WHEN OPENING A CUSTOMER ACCOUNT AND FOR CONTRACT PROCESSING

Pursuant to Art. 6 (1) lit. b DSGVO, personal data will continue to be collected and processed if you provide it to us for the performance of a contract or when opening a customer account. Which data is collected can be seen from the respective input forms. Deletion of your customer account is possible at any time and can be done by sending a message to the above address of the person responsible. We store and use the data provided by you for the purpose of processing the contract. After complete execution of the contract or deletion of your customer account, your data will be blocked with regard to tax and commercial law retention periods and deleted after expiration of these periods, unless you have expressly consented to a further use of your data or a legally permitted further use of data was reserved by our side.

6) COMMENT FUNCTION

In the context of the comment function on this website, in addition to your comment, information on the time of creation of the comment and the comment name you have chosen will be stored and published on this website. Furthermore, your IP address will be logged and stored. This storage of the IP address takes place for security reasons and in the event that the person concerned violates the rights of third parties or posts illegal content through a submitted comment. We need your e-mail address in order to contact you if a third party objects to your published content as being illegal. The legal basis for the storage of your data is Art. 6 para. 1 lit. b and f DSGVO. We reserve the right to delete comments if they are objected to by third parties as unlawful.

7) USE OF CUSTOMER DATA FOR DIRECT ADVERTISING

7.1 Registration for our e-mail newsletter

If you register for our e-mail newsletter, we will send you regular information about our offers. The only mandatory data for sending the newsletter is your e-mail address. The provision of further data is voluntary and will be used to address you personally. For sending the newsletter we use the so-called double opt-in procedure. This means that we will only send you an e-mail newsletter after you have expressly confirmed that you consent to receiving newsletters. We will then send you a confirmation e-mail asking you to confirm that you wish to receive the newsletter in the future by clicking on an appropriate link.

By activating the confirmation link, you give us your consent for the use of your personal data in accordance with Art. 6 (1) lit. a DSGVO. When you register for the newsletter, we store your IP address entered by your Internet service provider (ISP) as well as the date and time of registration in order to be able to trace any possible misuse of your e-mail address at a later date. The data collected by us when you register for the newsletter is used exclusively for the purpose of addressing you in an advertising manner by way of the newsletter. You can unsubscribe from the newsletter at any time via the link provided for this purpose in the newsletter or by sending a corresponding message to the person responsible mentioned at the beginning. After unsubscribing, your e-mail address will be deleted from our newsletter distribution list immediately, unless you have expressly consented to further use of your data or we reserve the right to use data beyond this, which is permitted by law and about which we inform you in this declaration.

7.2 Sending the e-mail newsletter to existing customers

If you have provided us with your e-mail address when purchasing goods or services, we reserve the right to regularly send you e-mail offers for similar goods or services to those already purchased from our range. In accordance with Section 7 (3) of the German Unfair Competition Act (UWG), we do not need to obtain your separate consent for this. In this respect, the data processing is carried out solely on the basis of our legitimate interest in personalized direct advertising in accordance with Art. 6 Para. 1 lit. f DSGVO. If you have initially objected to the use of your e-mail address for this purpose, no e-mails will be sent by us. You are entitled to object to the use of your e-mail address for the aforementioned advertising purpose at any time with effect for the future by notifying the responsible person named at the beginning. For this, you will only incur transmission costs according to the prime rates. After receipt of your objection, the use of your e-mail address for advertising purposes will cease immediately.

7.3 Newsletter dispatch via SuperMailer

Our e-mail newsletters are sent via the "SuperMailer" service, an offer from Mirko Böer, Malachitstraße 16, 04319 Leipzig, to whom we pass on the data you provided when registering for the newsletter. This transfer takes place in accordance with Art. 6 Para. 1 lit. f DSGVO and serves our legitimate interest in using an effective, secure and user-friendly newsletter system. The data entered by you for the purpose of receiving the newsletter (e.g. e-mail address) is stored on SuperMailer's servers in Germany or Ireland.

SuperMailer uses this information to send and statistically evaluate the newsletters on our behalf. For the evaluation, the newsletters sent by e-mail contain so-called web beacons or tracking pixels, which are single-pixel image files that are stored on our website. This makes it possible to determine whether a newsletter message has been opened and which links, if any, have been clicked on. With the help of so-called conversion tracking, it can also be analyzed whether a predefined action (e.g. purchase of a product on our website) has taken place after clicking on such links. In addition, technical information is collected (e.g. time of retrieval, IP address, browser type and operating system). The data is collected exclusively pseudonymously and is not linked to your other personal data, a direct personal reference is excluded. This data is used exclusively for the statistical analysis of newsletter campaigns. The results of these analyses can be used to better adapt future newsletters to the interests of the recipients.

If you wish to object to the data analysis for statistical evaluation purposes, you must unsubscribe from the newsletter.

We have concluded an order processing agreement with SuperMailer, with which we oblige SuperMailer to protect our customers' data and not to pass it on to third parties.

You can view SuperMailer's privacy policy here:

https://www.superscripte.de/register/html/datenschutz.htm

7.4 WhatsApp newsletter

If you subscribe to our WhatsApp newsletter, we will send you regular information about our offers via WhatsApp. Mandatory information for sending the newsletter is only your mobile phone number.

To send the newsletter, you add our cell phone number to the address contacts of your mobile device and send us the message "Start" via WhatsApp. By sending this WhatsApp message, you give us your consent for the use of your personal data in accordance with Art. 6 para. 1 lit. a DSGVO for the purpose of sending the newsletter. We will then add you to our newsletter distribution list.

The data collected by us when you register for the newsletter will be processed exclusively for the purpose of addressing you in an advertising manner by way of the newsletter. You can unsubscribe from the newsletter at any time by sending us the message "Stop" via WhatsApp. After unsubscribing, your mobile phone number will be immediately deleted from our newsletter distribution list, unless you have expressly consented to further use of your data or we reserve the right to use data beyond this, which is permitted by law and about which we inform you in this statement.

Please note that WhatsApp obtains access to the address book of the mobile device we use to send the newsletter and automatically transfers phone numbers stored in the address book to a Facebook server in the USA.

For sending our WhatsApp newsletter, we therefore use a mobile end device in whose address book only the WhatsApp contact data of our newsletter recipients are stored.

If you subscribe to our availability notification e-mail service, we will send you a one-time e-mail message about the availability of the item you have selected. Mandatory information for sending this notification is only your e-mail address. The provision of further data is voluntary and may be used to address you personally. For sending this notification we use the so-called double opt-in procedure. This means that we will only send you a corresponding notification once you have expressly confirmed that you consent to receiving such a message. We will then send you a confirmation e-mail asking you to confirm that you wish to receive such notification by clicking on an appropriate link.

By activating the confirmation link, you give us your consent for the use of your personal data in accordance with Art. 6 (1) lit. a DSGVO. When registering for our email notification service for the availability of goods, we store your IP address entered by the Internet service provider (ISP) as well as the date and time of registration in order to be able to trace a possible misuse of your email address at a later date. The data we collect when you register for our goods availability e-mail notification service is used solely for the purpose of informing you of the availability of a particular item in our online store. You can unsubscribe from the goods availability e-mail notification service at any time by sending a message to the responsible person mentioned at the beginning. If you are logged in to Facebook, Facebook can directly assign your visit to our website to your Facebook profile. If you interact with the plugins, for example by clicking the "Like" button or posting a comment, this information is also transmitted directly to a Facebook server and stored there. The information is also published on your Facebook profile and displayed to your Facebook friends.

The described data processing operations are carried out in accordance with Art. 6 (1) lit. f DSGVO on the basis of Facebook's legitimate interests in displaying personalized advertising to inform other users of the social network about your activities on our website and for the needs-based design of the Facebook service.

If you do not want Facebook to directly assign the data collected via our website to your Facebook profile, you must log out of Facebook before visiting our website. You can also object to the loading of the Facebook plugins and thus the data processing operations described above for the future using add-ons for your browser, e.g. the script blocker "NoScript" (http://noscript.net/).

For the purpose and scope of the data collection and the further processing and use of the data by Facebook, as well as your rights in this regard and setting options for protecting your privacy, please refer to Facebook's privacy policy:

10.2 Facebook plugins with 2-click solution

Our website uses so-called social plugins ("plugins") of the social network Facebook, which is operated by Facebook Ireland Ltd, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland ("Facebook").

To increase the protection of your data when visiting our website, the plugins are initially deactivated by means of a so-called "2-click" solution integrated into the page. You can recognize deactivated plugins by the fact that they are grayed out. This integration ensures that when you call up a page of our website that contains such plugins, no connection is yet established with the Facebook servers. Only when you activate the plugins and thus give your consent to the data transfer in accordance with Art. 6 (1) lit. a DSGVO, your browser establishes a direct connection to the Facebook servers. The content of the respective plugin is transmitted directly to your browser and integrated into the page. The plugin then transmits data (including your IP address) to Facebook. We have no influence on the scope of the data that Facebook collects with the help of the plugins. To our knowledge, Facebook in any case receives information about which of our websites you have currently and previously accessed. By integrating the plugins, Facebook also receives the information that your browser has accessed the corresponding page of our website if you do not have a profile on Facebook or are not currently logged in. The information collected (including your IP address) is transmitted from your browser directly to a Facebook Inc. server in the USA and stored there. If you interact with the plugins, the corresponding information is also transmitted directly to a Facebook server and stored there. The information is also published on Facebook and displayed there to your contacts.

You can revoke your consent at any time by deactivating the activated plugin by clicking on it again. However, the revocation does not affect the data that has already been transferred to Facebook.

For the purpose and scope of the data collection and the further processing and use of the data by Facebook, as well as your rights in this regard and setting options for protecting your privacy, please refer to Facebook's privacy policy: https://www.facebook.com/policy.php

In order to increase the protection of your data when visiting our website, these buttons are not unrestricted plugins, but are only integrated into the page using an HTML link. This type of integration ensures that when you call up a page of our website that contains such buttons, no connection is yet established with Facebook's servers. When you click on the button, a new browser window opens and calls up the Facebook page, where you can interact with the plugins there (possibly after entering your login data).

For the purpose and scope of the data collection and the further processing and use of the data by Facebook, as well as your rights in this regard and setting options for protecting your privacy, please refer to Facebook's privacy policy: https://www.facebook.com/policy.php

An overview of the Instagram plugins and their appearance can be found here: http://blog.instagram.com/post/36222022872/introducing-instagram-badges.

When you call up a page of our website that contains such a plugin, your browser establishes a direct connection to the servers of Instagram. The content of the plugin is transmitted by Instagram directly to your browser and integrated into the page. Through this integration, Instagram receives the information that your browser has called up the corresponding page of our website, even if you do not have an Instagram profile or are not currently logged in to Instagram. This information (including your IP address) is transmitted by your browser directly to a server of Facebook Inc. in the USA and stored there.

If you are logged in to Instagram, Instagram can directly assign your visit to our website to your Instagram account. If you interact with the plugins, for example by clicking the "Instagram camera" button, this information is also transmitted directly to an Instagram server and stored there. The information is also published on your Instagram account and displayed there to your contacts.

The described data processing operations are carried out in accordance with Art. 6 (1) lit. f DSGVO on the basis of Instagram's legitimate interests in displaying personalized advertising to inform other users of the social network about your activities on our website and for the needs-based design of the Instagram service.

If you do not want Instagram to directly assign the data collected via our website to your Instagram account, you must log out of Instagram before visiting our website. You can also object to the loading of the Instagram plugins and thus to the data processing operations described above for the future with add-ons for your browser, e.g. with the script blocker "NoScript" (http://noscript.net/).

11) USE OF SOCIAL MEDIA: VIDEOS

Use of Youtube videos

This website uses the Youtube embedding function to display and play videos from the provider "Youtube", which belongs to Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland ("Google").

The extended data protection mode is used here, which, according to the provider, only triggers the storage of user information when the video(s) is/are played. If the playback of embedded Youtube videos is started, the provider "Youtube" uses cookies to collect information about user behavior. According to information from "Youtube", these are used, among other things, to collect video statistics, to improve user-friendliness and to prevent abusive behavior. If you are logged in to Google, your data is directly assigned to your account when you click on a video. If you do not want the assignment with your profile at YouTube, you must log out before activating the button. Google stores your data (even for users who are not logged in) as usage profiles and evaluates them. Such an evaluation is carried out in particular in accordance with Art. 6 (1) lit. f DSGVO on the basis of Google's legitimate interests in the insertion of personalized advertising, market research and/or needs-based design of its website. You have the right to object to the creation of these user profiles, whereby you must contact YouTube to exercise this right. The use of YouTube may also result in the transmission of personal data to the servers of Google LLC. in the USA.

Regardless of a playback of the embedded videos, a connection to the Google network is established each time this website is called up, which may trigger further data processing operations without our influence.

Further information on data protection at "Youtube" can be found in the Youtube terms of use at https://www.youtube.com/static?template=terms as well as in Google's privacy policy at https://www.google.de/intl/de/policies/privacy.

As far as legally required, we have obtained your consent pursuant to Art. 6 (1) lit. a DSGVO for the processing of your data as described above. You can revoke your consent at any time with effect for the future. To exercise your revocation, deactivate this service in the "Cookie Consent Tool" provided on the website.

12) ONLINE MARKETING

12.1 Facebook Pixel for the creation of Custom Audiences (with Cookie Consent Tool).

Within our online offer, the so-called "Facebook Pixel" of the social network Facebook is used, which is operated by Facebook Ireland Limited, 4 Grand Canal Quare, Dublin 2, Ireland ("Facebook").

If a user clicks on an advertisement placed by us and played on Facebook, an addition is added to the URL of our linked page by Facebook Pixel. If our site allows data sharing with Facebook through Pixel, this URL parameter is inscribed in the user's browser via a cookie that our linked site sets itself. This cookie is then read by Facebook Pixel and enables the data to be forwarded to Facebook.

With the help of the Facebook Pixel, it is possible for Facebook, on the one hand, to determine the visitors to our online offer as a target group for the display of advertisements (so-called "Facebook Ads"). Accordingly, we use the Facebook pixel to display the Facebook ads placed by us only to those Facebook users who have also shown an interest in our online offer or who have certain characteristics (e.g. interests in certain topics or products determined on the basis of the websites visited), which we transmit to Facebook (so-called "Custom Audiences"). With the help of the Facebook pixel, we also want to ensure that our Facebook ads correspond to the potential interest of users and do not have a harassing effect. Thus, we can further evaluate the effectiveness of the Facebook ads for statistical and market research purposes by tracking whether users were redirected to our website after clicking on a Facebook ad (so-called "conversion").

The data collected is anonymous for us, so it does not allow us to draw any conclusions about the identity of the users. However, the data is stored and processed by Facebook, so that a connection to the respective user profile is possible and Facebook can use the data for its own advertising purposes, in accordance with the Facebook data usage policy (https://www.facebook.com/about/privacy/). The data can enable Facebook as well as its partners to place advertisements on and outside of Facebook.

The data processing associated with the use of the Facebook Pixel is only carried out with your express consent in accordance with Art. 6 Para. 1 lit. a DSGVO. You can revoke your consent at any time with effect for the future. To exercise your revocation, remove the check mark next to the setting for the "cookie consent" in the "Cookie Consent Tool" embedded on the website.

12.2 Google AdSense

This website uses Google AdSense, a web advertising service Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland ("Google"). Google AdSense uses so-called cookies, which are text files placed on your computer, to help the website analyze how users use the site. In addition, Google AdSense also uses so-called "web beacons" (small invisible graphics) to collect information, through the use of which simple actions such as visitor traffic on the website can be recorded, collected and analyzed. The information generated by the cookie and / or web beacon (including your IP address) about your use of this website is usually transmitted to a Google server and stored there. This may also involve transmission to the servers of Google LLC. in the USA.

Google uses the information thus obtained to carry out an evaluation of your usage behavior with regard to the AdSense ads. The IP address transmitted by your browser as part of Google AdSense will not be merged with other data from Google. The information collected by Google may be transferred to third parties if this is required by law and/ or if third parties process this data on behalf of Google.

The described processing of data is carried out in accordance with Art. 6 (1) lit. f DSGVO for the purpose of targeted advertising addressing of the user by advertising third parties, whose advertisements are displayed on this website on the basis of the evaluated user behavior. This processing also serves our financial interest in exploiting the economic potential of our website by displaying personalized third-party advertising content in return for payment.

You can obtain more information about Google's data protection policy at the following Internet address: https://www.google.de/policies/privacy/.

You can permanently deactivate cookies for advertising preferences by preventing them by setting your browser software accordingly or you can download and install the browser plug-in available at the following link:

https://www.google.com/settings/ads/plugin?hl=de

Please note that certain functions of this website may not be available or may be restricted if you have deactivated the use of cookies.

As far as legally required, we have obtained your consent pursuant to Art. 6 (1) lit. a DSGVO for the processing of your data as described above. You can revoke your consent at any time with effect for the future. To exercise your revocation, please follow the option described above for making an objection.

12.3 Use of Google Ads conversion tracking

This website uses the online advertising program "Google Ads" and within the scope of Google Ads the conversion tracking of Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland ("Google"). We use the offer of Google Ads to draw attention to our attractive offers with the help of advertising media (so-called Google Adwords) on external websites. We can determine how successful the individual advertising measures are in relation to the data of the advertising campaigns. In this way, we pursue the aim of displaying advertising that is of interest to you, making our website more interesting for you and achieving a fair calculation of the advertising costs incurred.

The conversion tracking cookie is set when a user clicks on an ad placed by Google Ads. Cookies are small text files that are stored on your terminal device. These cookies usually lose their validity after 30 days and are not used for personal identification. If the user visits certain pages of this website and the cookie has not yet expired, Google and we can recognize that the user clicked on the ad and was redirected to this page. Each Google Ads customer receives a different cookie. Cookies can therefore not be tracked across Google Ads customers' websites. The information obtained using the conversion cookie is used to create conversion statistics for Google Ads customers who have opted in to conversion tracking. The clients learn the total number of users who clicked on their ad and were redirected to a page tagged with a conversion tracking tag. However, they do not receive information that personally identifies users.

If you do not wish to participate in the tracking, you can block this use by deactivating the Google conversion tracking cookie via your Internet browser under the keyword "User settings". You will then not be included in the conversion tracking statistics. We use Google Ads based on our legitimate interest in targeted advertising pursuant to Art. 6 (1) lit. f DSGVO. The use of Google Ads may also involve the transmission of personal data to the servers of Google LLC. in the USA.

You can obtain further information about Google's data protection provisions at the following Internet address: https://www.google.de/policies/privacy/.

You can permanently object to the setting of cookies by Google Ads conversion tracking by downloading and installing the Google browser plug-in available at the following link:

https://www.google.com/settings/ads/plugin?hl=de

Please note that certain functions of this website may not be available or may be restricted if you have deactivated the use of cookies.

As far as legally required, we have obtained your consent pursuant to Art. 6 (1) lit. a DSGVO for the processing of your data as outlined above. You can revoke your consent at any time with effect for the future. To exercise your revocation, deactivate this service in the "Cookie Consent Tool" provided on the website or alternatively follow the option described above to make an objection.

12.4 Google Marketing Platform

This website uses the online marketing tool Google Marketing Platform of the operator Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland ("GMP").

GMP uses cookies to serve ads that are relevant to users, to improve campaign performance reports, or to prevent a user from seeing the same ads more than once. Via a cookie ID, Google records which ads are displayed in which browser and can thus prevent them from being displayed more than once. The processing is based on our legitimate interest in the optimal marketing of our website pursuant to Art. 6 (1) lit. f DSGVO.

In addition, GMP can use cookie IDs to record so-called conversions that are related to ad requests. This is the case, for example, when a user sees a GMP ad and later, using the same browser, calls up the advertiser's website and makes a purchase via this website. According to Google, GMP cookies do not contain any personal information.

Due to the marketing tools used, your browser automatically establishes a direct connection with Google's server. We have no influence on the scope and further use of the data collected by Google through the use of this tool and therefore inform you according to our knowledge as follows: Through the integration of GMP, Google receives the information that you have called up the corresponding part of our website or clicked on an advertisement from us. If you are registered with a Google service, Google can assign the visit to your account. Even if you are not registered with Google or have not logged in, there is a possibility that the provider may obtain and store your IP address. The use of GMP may also result in the transmission of personal data to the servers of Google LLC. in the USA.

If you wish to object to participation in this tracking procedure, you can deactivate cookies for conversion tracking by setting your browser to block cookies from the domain www.googleadservices.com, (see https://www.google.de/settings/ads), whereby this setting will be deleted when you deactivate your cookies. Alternatively, you can obtain information about setting cookies from the Digital Advertising Alliance at the Internet address www.aboutads.info and make your desired settings. Finally, you can set your browser so that you are informed about the setting of cookies and decide individually about their acceptance or exclude the acceptance of cookies for certain cases or in general. If you do not accept cookies, the functionality of our website may be limited.

You can obtain further information about the data protection provisions of GMP by Google at the following Internet address: https://www.google.de/policies/privacy/.

As far as legally required, we have obtained your consent pursuant to Art. 6 (1) lit. a DSGVO for the processing of your data as described above. You may revoke your consent at any time with effect for the future. In order to exercise your revocation, please follow the above described above to make an objection.

We have concluded an order processing agreement with HubSpot, with which we oblige HubSpot to protect our customers' data and not to pass it on to third parties.

You can permanently object to the collection of data by HubSpot using cookies and the setting of cookies by preventing the storage of cookies accordingly through your browser settings.

You can obtain further information about Hubspot's data protection policy at the following Internet address: https://legal.hubspot.com/de/datenschutz.

Insofar as legally required, we have obtained your consent pursuant to Art. 6 (1) lit. a DSGVO for the processing of your data as described above.
